Domestic Violence

If you feel unsafe, please know there are legal protections and support available to you right now. Domestic family violence (more properly referred to as Domestic and family violence) isn’t just physical and can include:

  • Emotional or psychological abuse.
  • Financial control or deprivation.
  • Coercive or controlling behaviour.
  • Sexual assault.
  • Threats, intimidation, and harassment.
  • Other behaviours which are outlined here.

Courts take family violence very seriously. You can apply for a Domestic Violence Order to help keep yourself and your children safe. A Temporary Protection Order is able to be made by the Court where there has been an act of domestic and family violence. A Protection Order (lasting 2-5 years) is able to be made by the Court where there has been an act of domestic and family violence, and the order is necessary and desirable for protection.

The existence of domestic and family violence within a relationship also influences decisions about parenting, property, child support and spousal maintenance.
